THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.6185 of 2013 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.39 of 2013 on the file of the Ballikurava Police Station, Prakasam District, registered for the offences punishable under Sections 417, 420, 506 and 509 I.P.C., Section 3(1)(x) of S.Cs. & S.Ts. (PoA) Act and Sections 3 and 4 of Dowry Prohibition Act.

Heard the learned counsel for the petitioner, learned Additional Public Prosecutor and the learned counsel for the 02nd Respondent - de facto-complainant and perused the material available on record. Since this Court granted stay, the investigation could not be proceeded further.

The learned Public Prosecutor submitted that necessarily the investigation to be conducted and the truth or otherwise of the complaint to be unearthed by the Investigation Agency. Considering the facts and circumstances of the case, this Criminal Petition is disposed of with the following direction : The Respondent-Police are at liberty to proceed with the investigation and file final report, if any, without arresting the petitioner.

Consequently, the Miscellaneous Petitions pending, if any, in this Criminal Petition shall stand closed.
