HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.8082 of 2015 ORDER:
This petition is filed by the petitioners-A2 to A4 under Section 439(1) Cr.P.C. seeking to relax the condition of appearing before the SHO, Kanchanbagh on alternate day between 9.00 a.m. and 5.00 p.m. till filing of charge sheet, imposed in Crl.M.P. No.1705 of 2015 in Crime No.126 of 2015 of P.S., Kanchanbagh, Hyderabad by the VII Additional Metropolitan Sessions Judge, Hyderabad. Heard and perused the material available on record. While granting anticipatory bail to the petitioners, the learned Sessions Judge imposed the condition that the petitioners shall appear before the Station House Officer, Kanchanbagh P.S., on every alternate day between 9.00 a.m. and 5.00 p.m. till filing of charge sheet vide order, dated 17.06.2015, in Crl.MP No.1705 of 2015. It is submitted by the learned counsel for the petitioners that the petitioners are complying with the condition imposed by the learned Sessions Judge from the date of order and therefore, he seeks relaxation of the said condition.
Considering the facts and circumstances of the case, this Court is of the view that the condition imposed by the learned Sessions Judge can be modified.
Accordingly, the Criminal Petition is disposed of modifying the condition imposed by the VII Additional Metropolitan Sessions Judge, Hyderabad in Crl.MP. No.1705 of 2015, dated 17.06.2015, as follows: "The petitioners - A2 to A4 in Crime No.126 of 2015 of Kanchanbagh Police Station, are directed to appear before the Station House Officer, Kanchanbagh, once in a week i.e. on every Sunday between 9.00 a.m. and 5.00 p.m., till filing of the charge sheet."
