THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14756 of 2025 ORDER:
This Criminal Petition is filed before this Court for grant of bail to the Petitioner who is arrayed as accused No.1 in FIR No.22/RCTACB-KNR/2025 of ACB, Karimnagar Range, registered for the offences punishable under Sections 7(a) of the Prevention of Corruption Act, 1988 (As amended in 2018).

The brief facts of the case are that on 10.10.2025, the de-facto complainant lodged a report before the police stating that A1 demanded a bribe amount of Rs.30,000/- to conduct a land survey and issue the corresponding report. Based on the complaint, the officials conducted an inspection and caught the petitioner redhanded while demanding the amount of Rs.30,000/-. Hence, the complainant requested that necessary action be taken against A1. Basing on the said complaint, the police registered a case for the above-said offences.

Heard Sri C.Hari Preeth, learned counsel appearing on behalf of the petitioner as well as Sri T.Bala Mohan Reddy, learned Standing Counsel for ACB SPL for respondent-State.

Learned counsel for the petitioner submitted that the petitioner is innocent of the said offences and that no such demand was ever
made by him. It is further submitted that the petitioner has been in judicial custody since 14.10.2025. The material part of the investigation is already completed. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition. 5.
On the other hand, the learned Standing Counsel opposed the submissions made by the learned counsel, stating that the allegations are serious in nature. It is further submitted that the recording under Section 183 of the BNSS is still pending before the Court. Therefore, he prayed the Court to dismiss the criminal petition. 6.
Considering the submissions made by both learned counsel and upon perusal of the material on record, it appears that the petitioner has been in custody since 14.10.2025. As seen from the record, the material part of the investigation has already been completed. The learned counsel for the respondent, on instructions, submits that statement under Section 183 of the BNSS accorded recently. Considering the facts and circumstances of the case, this Court finds it appropriate to grant bail to the petitioner/A1 subject to the following conditions.
i.
The petitioner/A1 shall execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned
Special Judge for SPE & ACB Cases at Karimnagar.
ii.
The petitioner/A1 shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner/A1 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).
