W.P.No.24722 of 2015 ORDER:

The petitioner questions the survey notice issued by the 3rd respondent on 29-07-2015 proposing to conduct survey with regard to the land admeasuring Ac.17-60 cents in Sy.No.17/5 situated at Avilala Village, Tirupati Rural Mandal, Chittoor District on 07-08-2015. The primary contention raised by the petitioner is that though he holds equal extent of land along with respondents 5 and 6 mentioned in the impugned notice, he has not been given notice of survey and notices are only issued to respondents 5 and 6 mentioned in the impugned notice. In any case, I do not see any reason to entertain the writ petition, as the petitioner even otherwise is aware of the survey proposed and he himself states that there was paper publication regarding proposed survey and the notice of survey itself is filed by the petitioner.

Thus, the petitioner being aware of the survey proposed to be conducted on 07-08-2015, it is open to him to present at the time of survey and if he seeks to file any objections, he can do so before the concerned survey officer. However, the survey proposed does not deserve to be interdicted.

Hence, the writ petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
