THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY AND THE HON'BLE SRI JUSTICE M.LAXMAN I.A.NO.1 OF 2021 IN F.C.A.NO.80 OF 2015 & FCA.NO.80 OF 2015 ORDER (Per the Hon'ble Sri Justice M.Laxman)
1. I.A.No.1 of 2021 is filed to record compromise entered into between the parties.
2. Appeal is filed by the wife granting decree of divorce at the instance of the husband. During the pendency of the appeal, the parties have entered into compromise.
3. As per the terms of the compromise, wife agreed to abide by the decree of divorce having agreed to receive Rs.15,00,000/- (Rupees fifteen lakhs only) towards permanent alimony or settlement.
4. Both the parties are present and they were identified by their counsel. The parties have admitted the contents of the joint memo filed by them and also the terms of compromise.
5. As per the terms of compromise an amount of Rs.5,00,000/- (Rupees five lakhs only) was already received by the wife and the balance of Rs.10,00,000/- (Rupees ten lakhs only) is paid today in the court by way of cheque.
6. I.A.No.1 of 2021 is allowed, and the joint memo filed by the parties and the terms of compromise are made part of this order.
7. Recording the same, the appeal is disposed of in terms of the compromise and decree be drawn accordingly incorporating the said terms.
8. However, it is made clear that in the event of cheque given by the respondent - husband is bounced for insufficient funds, the compromise now recorded stands recalled.
9. Interlocutory Applications pending, if any, shall stand closed. No order as to costs.
