Petitioner prays for the following relief:

"Writ of Mandamus, declaring the action of respondent police in not conducting the investigation in Crime No.95 of 2013 on the file of the Kushaiguda Police Station, registered under Section 323, 354, 406, 420 and 506 IPC, in collusion with the respondents 4 to 9 wanted to close the crime in question by filing final report as crime is civil in nature as illegal and void and opposed to Articles 14, 19 and 21 of Constitution of India."

The learned Assistant Government Pleader for Home submits that 3rd respondent investigated the crime and charge sheet was filed on 30.09.2013 in the court of X Metropolitan Magistrate, Malkajgiri. Since charge sheet is already filed, this court is of the view that the inaction complained, does not survive for consideration. By placing on record the statement of learned Assistant Government Pleader for Home, writ petition is dismissed. No order as to costs.
