THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION NO.6708 OF 2010 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.359 of 2009 on the file of the VII Metropolitan Magistrate, Hayathnagar, Cyberabad.

2. Learned counsel appearing for the petitioner-A6 seeks permission of this Court to permit the petitioner to withdraw the petition with a liberty to avail remedies available to him under law. Permission is accorded.

3. Learned counsel appearing for the petitioner submitted that the petitioner is facing much difficulty to attend the Court on each and every date of adjournment.

4. There is no dispute with regard to the identity of the petitioner. Even if the presence of the petitioner is dispensed with, no prejudice would be caused to the 1st respondent. Therefore, presence of the petitioner-A6 in C.C.No.359 of 2009 on the file of the VII Metropolitan Magistrate, Hayathnagar, Cyberabad is dispensed with on each and every date of adjournment. However, he shall appear before the trial Court as and when his presence is so required.
