THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.14759 of 2025 This Criminal Petition is filed before this Court for grant of bail to the Petitioner who arrayed as accused in FIR No.1192 of 2025 of KPHB Colony Police Station, Cyberabad Commissionerate, registered for the offences punishable under Section 69 of the Bharatiya Nyaya Sanhita (for short 'BNS').

The brief facts of the case are that, on 15.09.2025, the de-facto complainant lodged a report before the police stating that she has been acquainted with the petitioner for the past eight years. In the year 2022, the petitioner allegedly induced her with magical words, took her to his room, and sexually exploited her. Subsequently, under the pretext of marrying her, the petitioner is said to have continued to exploit her on multiple occasions.

The petitioner the de-facto complainant had physical relations as recently as June 2025. However, the petitioner later refused to marry her. Hence, the complainant requested to take necessary action. Based on the

said complaint, the police registered a case against the petitioner for the aforementioned offences.

Heard Sri P. Vamsheedhar Reddy, learned counsel appearing on behalf of the petitioner as well as Sri E. Ganesh, learned Assistant Public Prosecutor for respondent-State. 4.

Learned counsel for the petitioner submitted that the relationship between the petitioner the de-facto complainant was consensual in nature. Subsequently, both parties had approached their respective parents with a proposal for marriage; however, the parents did not approve of the alliance and advised them to live separately. He further submitted that the petitioner has got married to another, and there are no specific averments in the complaint that would attract the ingredients of an offence under Section 69 of BNS. Therefore, he prayed the Court to grant bail to him by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious in nature. Admittedly, the petitioner

herein exploited the de-facto complainant and the material part of the investigation is not yet completed. Therefore, he prayed the Court to dismiss the criminal petition. 6.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is observed that the petitioner has been in judicial custody since 19.10.2025. The record further reveals that there existed a relationship between the petitioner and the defacto complainant since the year 2022. Considering the overall facts and circumstances of the case, the nature of the allegations and the stage of investigation, this Court finds it appropriate to grant bail to the petitioner/accused, subject to the following conditions.

i.

The petitioner/accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned IV Additional Junior Civil Judge cum XV Additional Judicial Magistrate of First Class at Kukatpally, Medchal District.

ii.

The petitioner/accused shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, thereafter, as and when required.

iii.

The petitioner/accused shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
