HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.18939 OF 2016 ORDER:- This Writ Petition is filed by the petitioner challenging the inaction, on the part of the respondent authorities, on the petitioner's representation dated 30.11.2015 submitted not to install RO Plant under NTR Sujala Pathakam in Veeravallipalem Village pursuant to Resolution dated 27.09.2014 passed by the 6th respondent. It is the case of the petitioner that in Veeravallipalem village of Ainavilli Mandal a mineral water treatment plant was established and started drinking water services to the villagers from 06.05.2011 and is being maintained by the 6th respondent-Veeravallipalem Gram Panchayat. However, at the instance of the MPP of Ainavilli Mandal, the Gram Panchayat passed a resolution dated 27.09.

2014 to establish a new mineral water plant in Nadimilanka village, which is adjacent to Veeravallipalem village, under NTR Sujala Sravanthi Pathakam. Since there already a mineral water plant is existed in Veeravallipalem village, with a capacity of about 1000 ltrs., per hour, there is no requirement of establishment of another mineral water plant in the same village. In fact there is a dire need of establishment of new mineral water plants in 21 villages in Ainavilli Mandal like Vilasa, Maagam, Madupalle, Chintanalanka, Veluvalapalli, Potukurru etc., Therefore, he made representations dated 24.09.2014, 30.11.2015 and 30.11.2015 to the 2nd respondent-District Collector, with a request not to install RO plant in Veeravallipalem (V). However, no action has been taken by the respondent authorities. Hence, the writ petition.

Heard both the learned counsel.

Considering the limited prayer of the petitioner, without expressing any opinion, this writ petition is disposed of directing the

2nd respondent to consider the representation dated 30.11.2015 of the petitioner and take appropriate action in accordance with law within a period of four weeks from the date of receipt of a copy of this Order. With the above direction the Writ Petition is disposed of. There shall be no order as to costs.
