Aggrieved by the demand notice dated 01.08.2016 issued by the 2nd respondent Assistant Director of Mines & Geology (Vigilance), Ongole, by which a request was made to pay an amount of Rs.13,54,302/- towards normal seigniorage fee along with five times penalty, the petitioner had filed a Revision along with an Application seeking stay before the 1st respondent on 05.10.2016.
The petitioner asserts that neither the Stay Application nor the Revision has been disposed of so far, but however, the respondents are now seeking to enforce the demand made in the impugned notice.
Heard learned counsel for the petitioner as well as learned Government Pleader for Mines & Geology.
Since the Revision has already been filed and the same is pending consideration, without expressing any opinion, the interests of justice would be served if a direction is issued to the Revisional Authority to dispose of the Stay Application or the Revision within three months from the date of receipt of a copy of this order. Till then, the impugned demand notice dated 01.08.2016 shall be kept in abeyance.
With the above direction, the Writ Petition is disposed of. No costs.
Consequently, the miscellaneous Applications, if any are also disposed of.
