HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.3480 of 2017 ORDER :

Heard both sides.

Perused the grounds urged in the revision and the impugned docket order, dated 07.07.2017, in the pending suit O.S.No.9 of 2003 on the file of the X Additional Chief Judge, City Civil Court, Hyderabad.

It is the basic rule that among the rival claims of defendants, unless the co-defendant cross-examines the defendants, the plaintiff cannot be asked to cross-examine the said defendants. 4.

Having regard to the above, the docket order, dated 07.07.2017, is unsustainable. As the suit is pending for more than fourteen years, the trial Court shall make endeavour to dispose of the same, as early as possible, preferably within six months from the date of receipt of a copy of this order.

With the above direction, the civil revision case is disposed of. Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
