THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.5516 OF 2015 ORDER:

The petitioner alleges that on his complaint, Crime No.10 of 2015 was registered on 05.01.2015 by the 3rd respondent against the 5th respondent. However, the grievance of the petitioner in the present Writ Petition is that respondents 3 and 4 are frequently calling him to the Police Station and making him to sit hours together under the guise of investigation and therefore he seeks that the investigation into the said crime be completed without summoning him to the Police Station.

Learned Government Pleader for Home, on instructions, submits that after registration of crime, statement of the petitioner and other witnesses were recorded; that investigation is already completed and respondents 3 and 4 are in the process of filing final report. It is specifically stated that the petitioner is not at all required in the said case and that the allegation that that he has been summoned repeatedly and made to sit hours together in the Police Station is denied.

As the investigation is already completed and that the petitioner's presence is not required by the respondent Police,

no further orders are necessary in this Writ Petition. The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
