HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.31139 of 2014 ORDER:

This writ petition is filed stating that the maternal uncle of the petitioner by name Allu Narsaiah expired in the year 1999 and his wife also expired in the year 2000. Both of them have no issues, but own an extent of 1 Hector 96.5 cents situated at Arunachalapuram Village, Wazeedu Mandal, Khammam District and that the 5th respondent without any basis obtained pattadar passbook and title deeds by playing fraud. The petitioner also made representation on 12-03-2014 to the 3rd respondent in that regard. The 4th respondent sent notice in RC.No.A/2014, dated 24-01-2014 directing the petitioner to submit legal heir certificate and other relevant documents. Accordingly, the petitioner submitted all the documents, but no action has been taken. Aggrieved by the same, the present writ petition is filed. Heard learned counsel for the petitioner.

The Learned Assistant Government Pleader for Revenue produced written instructions in Rc.No.A/09/2014, dated 01-11-2014 that in pursuance of the notice issued by the 4th respondent for production of relevant documents, the petitioner has not submitted above documents and it is also stated Allu Narsaiah gifted the land to the 5th respondent as he has no children. As such, the 5th respondent was granted pattadar passbooks basing on the registered Will.

In view of the same, since the petitioner has not filed any documents, it cannot be said that the respondents have not proceeded further in the matter. In that view of the matter, it is open for the petitioner to produce relevant documents as sought by the 4th respondent in notice dated 2401-2014 within a period of three weeks from the date of receipt of a copy of this order and on such submission, the competent authority has to pass appropriate orders. If no documents are filed within the aforesaid period, it is deemed that enquiry is closed.

Accordingly, the writ petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
