Ravinder, learned counsel for the petitioner and Sri Taddi Nageswara Rao for respondent No.2. None appears for the contesting respondent No.4.
The petitioner was admitted to M.B.B.S. course from 'B' category. He had furnished bank guarantee for tuition fee chargeable for the remaining course. Thereafter, he furnished one more bank guarantee for Rs.9 lakhs towards tuition fee chargeable for succeeding year and then approached this Court seeking withdrawal of the first bank guarantee.
He made such prayer in view of the subsequent G.O.Ms.No.73, dated 26.08.2015 (Annexure P-6), issued by the Government.
Similar prayer was made in W.P.No.26906 of 2015 and it was granted by a Division Bench of this Court vide order, dated 27.08.2015. Learned counsel for the respondent has not opposed the prayer. In view thereof and having considered G.O.Ms.No.73, we dispose of this writ petition by the following order:
"Respondent No.4 is directed to return the bank guarantee of Rs.36 lakhs furnished by the petitioner within a period of three weeks from today, retaining the bank guarantee for Rs.9 lakhs furnished by him for a period of one year expiring on 31.08.2016 towards the tuition fee for
the academic year 2015-16. Petitioner to furnish an undertaking to this Court within a period of three weeks from today that he shall renew the bank guarantee from time to time for every succeeding year. It is needless to mention that petitioner shall forward a copy of his undertaking to respondent No.4."
