THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.18875 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking issuance of Writ of Mandamus declaring the action of respondent No.5 in harassing the petitioner at the instance of respondents 6 and 7 by frequently calling the petitioner to Police Station and threatening the family members of the petitioner in his absence without following due process of law, as illegal and arbitrary.

Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Home. With their consent, the Writ Petition is disposed of at the stage of admission itself. Since this Court is not going into the merits of the case, there is no necessity to put respondents 6 and 7 on notice. Though various grounds are raised in the writ petition, the learned counsel for petitioner restricts his prayer seeking a direction to the respondents-Police not to harass the petitioner by calling him to Police Station, at the instance of respondent Nos.6 and 7.

Though no counter is filed, the learned Assistant Government Pleader, on telephonic instructions, submits that the allegations made in the Writ Petition are false. Having regard to the rival submissions made, the Writ Petition is disposed of directing the respondents-Police to follow due process of law, if they intend to take any action against the

petitioner, and not to summon the petitioner to Police Station, except in accordance with law.

Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
