THE HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.33006 OF 2018

O R D E R

The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, that this Hon'ble Court may be pleased to issue writ, order or direction, more particularly one in the nature Writ of Mandamus declaring the in action of the 4th Respondent in not incorporating petitioner name in the pahanies in respect of the agricultural land in Sy.No.362 admeasuring Ac 0-36 gts situated at Anantasagar village, Chegunta Mandal, Medak District, pursuant to the proceeding No.B/771/2014 dt.30.08.2014 as illegal, arbitrary and in violation and contrary to the provisions of A.P. Rights in Land & Pattadar Pass Book Act, 1971. Consequently direct the respondents to incorporate petitioner name in the pahaneis as a pattadar and possessor in respect of agriculture land in Sy.No.362 admeasuring Ac 0-36 gts. situated at Anantasagar village, Chegunta Mandal, Medak District and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and in the interest of justice.'

It is an admitted fact that the petitioner's name was entered in the revenue records in relation to the land admeasuring Ac.0.36 guntas in Survey No.362 of Anantasagar Village, Chegunta Mandal, Medak District. He was also issued a pattadar pass book under the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, 1971 in this regard. However, it appears that his name is not being shown in the pahanies, in the columns pertaining to 'pattadar' and 'possessor', in so far as this land is concerned.

Despite the matter undergoing three adjournments, the learned Assistant Government Pleader for Revenue, State of Telangana, is unable to assist this Court as he was not furnished with any instructions.

It appears that the petitioner already made an application in this regard to the Office of the District Collector, Medak District, on 20.02.2018. The copy thereof placed before this Court bears the endorsement of the Collector's Office in proof of its receipt. In that view of the matter, as the District Collector, Medak District, being the highest revenue authority in the district, is bound to ensure that the subordinate authorities act in accordance with the norms, the writ petition is disposed of directing the District Collector, Medak District, to initiate appropriate action on the petitioner's application dated 20.02.2018 and ensure that suitable action is taken at the level of the Tahsildar, Chegunta Mandal, Medak District, in so far as the maintenance of revenue records is concerned. This exercise shall be completed expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order.
