THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.6268 OF 2017 ORDER:
This Writ Petition under Article 226 of the Constitution of India is filed by the petitioner seeking to declare the action of the respondents in not implementing the orders of the 3rd respondent for appointing the petitioner as hereditary trustee of the 4th respondent-Temple as illegal and arbitrary and consequently to direct the 2nd respondent to declare the petitioner as hereditary trustee of the 4th respondent-Temple.
Heard the learned counsel for the petitioner, learned Government Pleader for Endowments and learned Standing Counsel for 4th respondent.
As can be seen from the order dated 25.05.2010 passed by the 3rd respondent in O.A.No.115 of 2008, the petitioner was already declared as a Founder Family Member of the 4th respondent-Temple. In that view of the matter, the relief, which the petitioner claims in the present writ petition for declaring her to be a Founder Family Member, in fact, stands granted. Yet another grievance of the petitioner is that though the Assistant Commissioner, Endowments Department, Guntur, by letter dated 31.01.2011 had requested the 2nd respondentCommissioner to take necessary steps for constitution of the Trust Board, no steps are taken so far.
In order to encourage philanthropists and other devotees of the 4th respondent-Temple to participate in the affairs of the
Temple and to fulfill the objects for which the Temple has been donated Acs.14.38 cents, it would be apt to direct the 2nd respondent to take steps for constitution of a Trust Board. Accordingly, the Writ Petition is disposed of directing the 2nd respondent to take necessary immediate steps for constitution of a Trust Board, in terms of the recommendations made by the Assistant Commissioner in his letter dated 31.01.2011, within a period of twelve weeks from the date of receipt of a copy of this order by following due process of law.
Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. No order as to costs.
