PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Learned counsel for the appellant does not press these appeals and seeks liberty to the appellant to file civil suit for declaration and consequential reliefs against the proper parties including some of the respondents and seeks direction to the Civil Court to consider and decide the suit on merits in accordance with law and uninfluenced by the observations made in the instant proceedings including the impugned judgments. He also seeks direction to the Civil Court to decide the suit expeditiously and also the applications, if any, filed by the appellant for interim order. Learned counsel appearing for the respondents have no objection for granting such liberty.

In view thereof, we are satisfied that the following order shall meet the ends of justice:

The appeals are disposed of as not pressed. It is open to the appellant to file civil suit for declaration and appropriate relief/reliefs as advised. If the civil suit, as aforementioned, is instituted by the appellant, the Civil Court shall consider and decide the same on merits in accordance with law and uninfluenced by observations made in the instant proceedings including the impugned judgments passed in W.P.No.29306 of 2014 and the companion writ petitions. It is open to the appellant to file application for interim relief, if he so desires and advised, against the proposed defendants and if any such application/applications is/are filed, the Civil Court shall consider the same on merits in accordance with law and uninfluenced by the observations made in the impugned judgments. All contentions of the parties on merits are kept open. Miscellaneous petitions, if any, also stand disposed of. _________________________ DILIP B. BHOSALE, ACJ
