THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37359 of 2016 ORDER:

In this writ petition, the petitioners seek a direction to the respondents not to evict them from the land to an extent of Ac.4.10 cents in R.S.No.257/1, situated at Chenchugudem Village, H/o.Buttaigudem Village & Mandal, West Godavari District without following due process of law.

The petitioners allege that the respondents have been trying to dispossess them from the land in question without issuing any notice or initiating eviction proceedings. On the other hand, the learned Government Pleader submits that the petitioners are not in possession of the land in question.

Heard and perused the material available on record. Considering the grievance of the petitioners, without expressing any opinion regarding the possession of the petitioners over the land in question, if the petitioners are found in possession of land as alleged, the respondents are hereby directed not to dispossess the petitioners from the said land without following the due process of law. With the above direction, the writ petition is disposed of. No order as to costs.
