HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.33098 of 2018 ORDER :

Heard learned counsel for the petitioner and learned Government Pleader for Revenue (Andhra Pradesh).

With the consent of both parties, the Writ Petition is disposed of at the admission stage.

The present Writ Petition came to be filed questioning the impugned order Rc.No.370/2017, dated 21.07.2017, issued by respondent No.3, to evict the petitioner from plot No.22 regularized through ULP No.25/89, admeasuring 266.67 square yards in R.S.No.177/B3A situated at Kanuru, Penamaluru Mandal, Krishna District, Andhra Pradesh. 4.

At the time when the matter is taken up for hearing, when it was pointed out to the learned counsel for the petitioner, to explain as to why there is a delay in challenging the impugned order, though it was passed in the month of July, 2017, the learned counsel for the petitioner could not explain the same. But it is to be noted here that against the order passed by the Tahsildar dated 21.07.2017, an appeal would lie. 5.

In view of the above, giving liberty to the petitioner to avail the remedy available under law, if permissible under law, the Writ Petition is disposed of.
