HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.13393 of 2013 ORDER:
The petitioners/Accused Nos.1, 3, 4, 11, 16, 18, 20 to 27 filed the instant petition under Section 482 Cr.P.C, seeking to quash the proceedings in C.C.No.975 of 2013 on the file of Additional Judicial Magistrate of First Class, at Karimnagar.
2) The facts of the case are that:
a) On the night of 30.10.2013, when the S.I of Police, Ramadugu P.S, Karimnagar District along with P.C 691 and HC 743 went to Kokkerakunta village on patrolling duty on the eve of polling to be held on the next day for cooperative elections, they found about 30 persons in a group near Hanuman Temple at Kapuwada chowrastha and the police asked them to disburse in view of the Election Code in force but the accused who were in group did not heed their advise and on the other hand they challenged the police and broke the window pans of the Maruthi Car of the S.I of Police and beat the Constables and created vandalism. With the above allegations, the police filed charge sheet against the accused for the offences under Sec.143, 353, 332, 427, 506 r/w 149 IPC. Hence, the instant petition.
3) Denying the charge sheet allegations, learned
counsel for petitioners submitted that a false case was foisted against the petitioners on the instigation of the rival group and there is no truth in the allegation.
4) A perusal of the record shows that there is a prima facie material in the contents of the charge sheet. As such and in view of the gravity of the offence, it is not a fit case to quash the proceedings.
5) Accordingly, this Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
