HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE G. SHYAM PRASAD Writ Petition No.36443 of 2016 ORDER: (per V. Ramasubramanian, J.) The petitioner has come up with the above writ petition challenging the notice under Section 13 (2) of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act).
2. Heard the learned counsel for the petitioner.
3. At this stage, the writ petition is not maintainable. The petitioner should give a reply and only if the objections are rejected under Section 13 (3-A) of the Act and measure are taken under Section 13 (4), the petitioner will have a cause of action.
4. Therefore, the writ petition is dismissed, leaving it open to the petitioner to make payment or to take steps after the measures are initiated under Section 13 (4) of the Act.
