THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.7820 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a writ order or direction more particularly one in the nature of Writ of Mandamus, declaring the proceedings of the 3rd respondent bearing notice No.A2/80/SA/DWMA/2015, dated 02.11.2015, whereby and whereunder the services of the petitioner are suspended as illegal, arbitrary and unjust and set aside the same and consequently, direct the respondents to reinstate the petitioner into service forthwith and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

2. When the matter is called, it is represented by learned counsel for the petitioner so also the learned standing counsel appearing for the respondents that the issue in the present writ petition is similar to the issue in the W.P.No.40150 of 2015 and this Court disposed of the said writ petition by way of an order dated 11.12.2015 and the similar order may be extended to the petitioner also.

3. In view of the same, there shall be similar order in this case also. "Accordingly, the Writ Petition is dismissed. However, since the explanation is already filed by the petitioner, the Project Director and Additional District Programme Coordinator, DWMA, East Godavari District, Kakinada (3rd respondent) is directed to finalize the disciplinary action, as expeditiously as possible, preferably within a period of one month from the date of receipt of copy of this order. If disciplinary proceedings are not concluded within a period of one month from the date of receipt of copy of this order, the petitioner shall stand reinstated."

4. In view of the above, the present Writ Petition is also dismissed.

Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 10.03.2016 SS
