Heard Smt. A. Chayadevi for petitioners and the learned Assistant Government Pleader for respondents.
2. The petitioners complain against inaction of respondents in conducting survey to an extent of Ac.35.00 cents in Sy. Nos.77/ 10 A1, 77/ 10 A3, 77/ 10 A4, 77/ 10 A5, 77/ 10 A6 & 77/ 10 A7 of Vepagunta village, Pendurthi Mandal, Visakhapatnam District on the applications made on 24.04.2017, 26.04.2017, 13.05.2017, 16.05.2017, 03.06.2017 and 08.06.2017, as illegal.
3. The writ petition is filed on 12.06.2017. The curious aspect in this writ petition is the petitioners complain against the inaction in conducting survey after complying with the requirements of depositing survey fees on 08.06.2017. In these chronological events happening on the quick heels of one another in quick succession, this court has difficulty to accept that there is delay or inaction on the applications filed by the petitioners. The petitioners ought to give some reasonable and breathing time to the respondents to act on their applications. At this stage, the inaction complained is not made out. However, an opportunity is given to the petitioners to demand for compliance of survey and this court is of the view that 5th respondent does the needful on the request of petitioners.
4. With the observation, the writ petition is dismissed. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
