Heard.

The petitioner alleges that respondents 3 and 4 are interfering with the civil dispute of the petitioner and are supporting the 5th respondent with a view to put him in possession of the properties in question.

Learned Government Pleader has received instructions from the 4th respondent, which state that the 5th respondent lodged a complaint against the petitioner and two others on 14-03-2015 and based on that, a case in Cr.No.30 of 2015 was registered under Sections 447, 323 and 506 read with 34 IPC on the file of Allavaram Police Station, East Godavari District. The petitioner is stated to be A-3 in the said Crime. During the course of investigation, the investigating officer examined the complainant and recorded his statement and the investigation is at the preliminary stage and some more witnesses are required to be examined apart from collecting material evidence.

It is also stated that the petitioner's presence is required in the said Police Station for the purpose of investigation and based on the outcome of the investigation, appropriate further steps will be taken. So far as the petitioner's allegation regarding interference with the civil dispute is concerned, the same is denied and it is stated that mere registration of the crime against the petitioner does not amount to interference with civil dispute and that police are nothing to do with the civil dispute pending between the petitioner and the 5th respondent.

In view of that, therefore, as the aforesaid crime is registered against the petitioner, the petitioner shall co-operate with the investigation by approaching the police station, referred to above, and give his statement. Accordingly, the writ petition is disposed of. No order as to costs.
