HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1659 of 2016 ORDER:

This revision is preferred against proceedings, dated 18.05.2016, passed in D.Dis. No.610/2016 by the Revenue Divisional Officer and Sub-Divisional Magistrate, Kalyanadurg. Heard and perused the material available on record. The case of the petitioners is that their vehicles i.e. four tractors and trailors were seized by the Bommanhal Police in crime No.26 of 2016 for the offences under Sections 379 IPC and 27 and 35(ii) of AP WALTA. Thereafter, the vehicles were handed over to the Revenue Divisional Officer and the Revenue Divisional Officer passed the proceedings impugned, confiscating the vehicles to the State, after giving notice to the petitioners. Challenging the same, this revision is filed.

When the matter is taken up for hearing learned Additional Public Prosecutor submitted that the petitioners without availing the remedy of appeal before the appropriate forum, straightaway approached this Court and therefore, this revision is not maintainable. In view of the above submission of the learned Additional Pubic Prosecutor, this revision case is dismissed. However, the petitioners are at liberty to approach the appropriate forum and seek appropriate remedy.
