Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondent Municipality. The grievance of the petitioner is that without constructing the drainage channels, the respondent authorities are raising the existing low level CC road. According to the petitioner, if it is permitted, it would result in inundation and submergence of the houses situated by the side of the road. On the other hand, it is submitted by the learned Standing Counsel that the petitioner is a proxy for the unsuccessful tenderer and he has no locus standi to question the action of the respondents in getting the road laid.
A perusal of the Tender Notification, it is clear and vivid terms disclosed that the respondent municipality invited tender for the purpose of raising of existing low level CC road and drain from D.No.5/ 458 to 5/ 462-A at Church street in 9th ward under SFC Grant. Once the tender is called for for the purpose of laying the road and the adjacent drainages, which is evident from the notification, there is absolutely no basis in the apprehension of the petitioner herein that the respondents would not construct the drainages.
In view of the same, this Court does not find any merit in the present Writ Petition.
Accordingly, this Writ Petition is dismissed. As a sequel, the miscellaneous petitions, if any, pending shall stand closed.
