HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.9823 OF 2018 ORDER:

The petitioner is the sole accused in Crime No.3 of 2018 on the file of Saluru Rural Police Station, Vizianagaram District. The crime is registered on 16.02.2016 originally for the offences punishable under Sections 417 & 420 IPC and the police after investigation from the DNA examination showing the paternity of accused to the child born to the victim from the positive result yielded included the offence of Section 376 IPC.

Heard the learned counsel for petitioner and the learned Special Assistant Public Prosecutor representing the State of Andhra Pradesh in opposing the same and perused the F.I.R. and the bail application averments.

The petitioner earlier obtained anticipatory bail from this Court in Crl.P.No.10555 of 2016 by order dated 28.07.2016. It is subsequently from the adding of Section 376 IPC the present anticipatory bail application is moved. In fact, once the anticipatory bail in non-bailable offence is granted, even the additional sections are added that will not cancel the earlier bail much less if any need of obtaining a fresh bail.
