HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.10175 of 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C by the petitioner/ A1, seeking to quash the proceedings in C.C.No.15 of 2013 on the file of the Special Judge for SPE & ACB Cases, Vijaywada, where taken cognizance for the offences punishable under Sections 120-B r/ w 420, 409, 468, 471, 477-A IPC and Sections 9, 11, 12, 13(2) r/ w Section 13(1)(c) and (d) of the Prevention of Corruption Act, 1988.

Heard the petitioner/ A1, party-in-person, Special Grade Deputy Collector (Retired) and the learned Special Public Prosecutor for respondent/ State Anti Corruption Bureau, represented by its Range Inspector, Vijayawada Range. Perused the report received from the learned Special Judge for SPE and ACB Cases-cum-III Additional District Judge, Vijayawada. The report discloses that discharge petitions of A1 (party-in-person), A6, A7, A9 and A12 among A1, A6,A8, A9, A10 and A12 facing trial among 12 accused as pending Crl.MP.Nos.480 of 2013, 133 of 2014, 1027 of 2015, 1189 of 2014 and 507 of 2015 in C.C.No.15 of 2013 and it is posted for hearing of the discharge petitions to 06.12.2018.

The party-in-person submits that the same material herein filed before the lower Court in seeking discharge and not that additional material.

Having regard to the above, the learned Special Judge is directed to dispose of the discharge applications on own merits, within a period of thirty days from the date of receipt of copy of this order. Further grievances of the petitioner if any, are left open.
