CVNR, J CC 1642/2016 ORDER:

This contempt case is filed alleging wilful disobedience of order dt.07.9.2015 in C.C. No.42 of 2015 in Company Application Nos.30 and 663 of 2015 in Company Petition No.81 of 2013. Mr. M.V. Pratap Kumar, learned counsel for the petitioner, submitted that despite the categorical undertaking given by respondent No.1 in Contempt Case No.42 of 2015 that he will pay the balance amount by 31.3.2016 he failed to make such payment.

Mr. Pushyam Kiran, learned counsel for respondent No.1, submitted that his client will pay the entire balance amount agreed to be paid by him as recorded in order dt.07.9.2015 within four weeks from today. The submission of Mr. Pushyam Kiran is placed on record and the contempt case is closed with liberty to the petitioner to seek revival of the same in the event the payment is not made as undertaken by respondent No.1.
