HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.941 OF 2017 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the action of the 2nd respondent in trying to dispossess the petitioner from the property situated in T.S.No.1/1, Block B, Ward No.8 under co-related survey Nos.126/P, 127/P and 125/P admeasuring 125 Sq. Yards of open land with room in Indira Nagar locality bearing H.No.8-3-169/60/240, Yousufguda Village, Khairatabad Mandal, Hyderabad, as illegal and arbitrary.
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue for respondents. With their consent, the Writ Petition is disposed of at the stage of admission itself.
Though various grounds are raised in the writ petition, the learned counsel for the petitioner submits that the authorities are trying to dispossess her, without following due process of law, from the subject property, which was allotted/regularized by virtue of proceedings of the Tahasildar bearing No.BPLHYD150425060953 dated 01/06/2015.
Learned AGP would submit that though the petitioner was allotted with 125 Sq.Yards of land, she is trying to encroach on to the adjacent land, which belongs to Government. However, the same is seriously disputed by the learned counsel for the petitioner.
Having regard to the rival submission made, the Writ Petition is disposed of directing the respondents not to dispossess the petitioner from the property in T.S.No.1/1, Block B, Ward No.8 under co-related survey no.126/P, 127/P and 125/P admeasuring 125 Sq. Yards of open land with room in Indira Nagar locality bearing H.No.8-3-169/60/240, Yousufguda Village, Khairatabad Mandal, Hyderabad, without following due process of law. Miscellaneous petitions pending in this petition, if any, shall stand closed. No costs.
