THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44682 OF 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of mandamus directing the respondents not to harass the petitioners under the guise of F.I.R.No.379 of 2016 on the file of the third respondent and also declaring the action of the respondents in threatening and harassing the petitioners without any implication of any offence in the said F.I.R., as illegal and arbitrary. Heard and perused the material.

Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present crime registered for the offences under Sections 408, 468 and 471 IPC read with Section 34 IPC and that they have not committed any of the offences alleged against them. He further submits that the third respondent is threatening and harassing the petitioners in the guise of investigation and as such, he prays this Court to quash the F.I.R. This Court is not inclined to quash the proceedings at the threshold since it is a case of forging the document and using the said forged document as genuine one. But, at the same time, the petitioners being the ladies, are directed to surrender before the Investigating Officer concerned on or before 20.01.

2017 and on such surrender, the Investigating Officer is directed to take them into custody and obtain handwritings and signatures of the petitioners for the purpose of investigation. The Investigating Officer is further directed to release the petitioners on the same day on which the petitioners surrendered after obtaining the handwritings and signatures and also on petitioners executing a personal bond for a sum of Rs.
