HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.5078 of 2014 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to declare the action of respondents Nos.3 and 4 in conducting examinations for allotment of Civil Supplies Shop vide proceedings No.E2/2745/2013, dated 27.11.2013, as illegal and arbitrary and consequently, to set aside the same.

The impugned proceedings were issued for selection for the post of Government ration shop dealer. The petitioner belongs to Scheduled Tribe caste. The grievance of the petitioner is that he was qualified in the selection procedure and secured highest marks, but the respondents have not selected him.

In the proceeding sheet, it was recorded that on 28.2.2014, the learned Assistant Government Pleader for Civil Supplies submitted that the petitioner has secured 68 marks and the person who was appointed in the post in question, secured 70 marks. It is further submitted that the petitioner has not made the person, who was appointed in the post in question, as a party to the present writ petition. 4.

In view of the submissions made by the learned Assistant Government Pleader for Civil Supplies earlier, this Court is of the view that there are no merits in this writ petition and hence, the writ petition is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed. ________________ RAJA ELANGO, J Date: 17th April, 2017 Nn
