THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.35134 of 2014 ORDER:
Heard learned counsel for the petitioner as well as learned Government Pleader for respondent Nos.1 to 4. 2.
The prayer sought in the writ petition is as under:- "...to issue a Writ, Order, or Direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the police authorities in summoning the Petitioner to the Police Station in the name of settlement of Civil dispute is illegal, unconstitutional and consequently direct the police authorities not to pressurize the petitioner either to withdraw the suit in O.S.No.9 of 2014 on the file of Junior Civil Judge, Peddapally or to give away the Suit Schedule land to the 5th Respondent and pass such further order or orders as this Hon'ble court may deem fit and proper in the circumstances of the case."

Learned Government Pleader placed on record the written instructions, dated 24.11.2014, issued by the Station House Officer, Peddapalli Police Station, Karimnagar District. 4.
From a perusal of the said written instructions, it is revealed that on verification of the records as on the date of issuance of the written instructions, no complaint whatsoever is received or registered against the petitioner on the file of the Peddapalli Police Station, Karimnagar District. It is also mentioned that the respondent police never summoned the petitioner nor made him to sit in the police station for hours together and asked him to withdraw the suit filed against the defendants therein.

Taking the above said facts into consideration, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed.

Accordingly, the writ petition is closed. However, liberty is given to the petitioner to approach the concerned police as and when required. Miscellaneous petitions pending, if any, shall stand closed. No costs.
