THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.8773 of 2016 ORDER:

This petition under Section 482 Cr.P.C. is filed by the petitioner/A.1 seeking to quash the proceedings in S.T.C.No.231 of 2016 on the file of Special Judicial Magistrate of Second Class, Tirupathi against him.

Heard the learned counsel appearing for the petitioner/A.1 and the learned Additional Public Prosecutor representing the State. A perusal of the complaint, discloses that there is material which is sufficient to proceed with the trial and prima-facie, it cannot be said that it is a fit case that the proceedings are liable to be quashed. In that view of the matter, the Criminal Petition is disposed of directing the learned Magistrate to proceed with the trial in S.T.C.No.231 of 2016 and dispose of the same within six (6) months from today, without further insisting for the presence of petitioner/A.1 on each and every adjournment, unless it feels that his presence is necessary for any specific purpose.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
