This Transfer CMP is filed by the petitioner/husband for transfer of FCOP.No.1188 of 2014 filed by him for restitution of conjugal rights, pending on the file of the Family Court, Visakhapatnam to the Family Court, Vizianagaram to be tried along with FCMC.No.15 of 2015.

The case of the petitioner that his marriage with the respondent was performed on 12.06.2011 at Sivajipalem, Visakhapatnam and out of their wedlock, they blessed with a male child. Thereafter, since the respondent left the matrimonial house, without any reasonable cause, the petitioner filed FCOP.No.1188 of 2014, before the Family Court, Visakhapatnam for restitution of conjugal rights. Meanwhile, the respondent also filed FCMC.No.15 of 2015 on the file of the Family Court, Vizianagaram seeking maintenance. As such, for the sake of convenience and to avoid conflicting judgments, the petitioner filed this transfer petition. The respondents filed counter consenting to transfer FCOP.No.1188 of 2014 from the Family Court, Visakhapatnam to the Family Court, Vizianagaram to be tried along with FCMC.No.15 of 2015.

Heard both sides.

Since the respondents have stated no objection for allowing the present transfer petition, this transfer CMP is allowed and FCOP.No.1188 of 2014 pending on the file of the Family Court, Visakhapatnam is transferred to the Family Court, Vizianagaram to be tried along with FCMC.No.15 of 2015. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending
