THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10264 OF 2015 ORDER:
This Criminal Petition is filed by the petitioner- A1, under Section 438 of the Code of Criminal Procedure, seeking to grant bail in Crime No.254 of 2015 on the file of Pedakakani Police Station, Guntur Urban, registered for the offences punishable under Sections 290 and 353 read with 34 IPC. Heard and perused the material available on record. The case of the prosecution is that in a public hearing that was held on 23.07.2015 to find out the facts in the suicide case of Ms. Rishiteswari, the students shouted at each other with contradicting demands and quarreled on provocation of the petitioner, therefore, the Registrar of Acharya Nagarjuan University filed the present complaint.
Learned counsel for the petitioner submitted that as the petitioner voiced about the involvement of the Principal concerned in the public hearing, he was falsely implicated in the present case, and the investigation is also completed and the charge sheet has been filed and as the petitioner was shown as absconding, NBW was issued against him and therefore, he may be granted anticipatory bail. In view of the submission made by the learned counsel for the petitioner, this Court is of the view that this criminal petition can be disposed of with the following directions:
The petitioner-accused No.1 is directed to appear before the Court concerned and file an application to recall the NBW pending against him and on filing of such application, the trial Court is directed to recall the NBW on the same day on his execution of a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for the like sum and further the petitioner is directed to appear before the trial Court regularly.
