THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.14085 of 2017 ORDER:

This writ petition is filed by the petitioners, under Article 226 of the Constitution of India, seeking to declare the action of the 2nd respondent in not disposing the petitioner's representation, dated 18.11.2016, as illegal, arbitrary and violation of principles of natural justice and consequently direct the 2nd respondent to dispose of the representation, dated 18.11.2016, submitted by the petitioner within a period of stipulated time. 2.

Heard both sides and perused the material available on record. With the consent of both the counsel, the writ petition is taken up for disposal at the stage of admission. 3.

The case of the petitioners is that the petitioners help and developed the temple of Sri Harihara Putra Ayyapa Swamy and other temples, situated at Zilla Parishad Residential Quarters, Karimnagar. The Government of Telangana issued G.O.Rt.No.220, dated 18.05.2016, for handing over the temple to the Zilla Parishad, Karimnagar, and exempted Sections 15 & 29 of the Hindu Religious Institutions and Endowment Act, 1987 (for short, 'the Act') by removing the E.O. & A.C. under Section 154 of the Act and after issuing the said G.O., the position of the temple became worst and on 03.11.2016, the Nagula Putta, which is a holy place to the devotees, was also removed by the 5th respondent employees and the temple Archakas have not received their salaries from the Zilla Parishad Office and they are facing lot of financial problems. RE,J W.P.No.14085 of 2017 submitted a representation, dated 18.11.2016, to the 2nd respondent requesting to take necessary legal and disciplinary action on the employees of the Zilla Parishad, who are giving troubles and creating nuisance by their illegal activities in the temple and requested for handing over the Sri Harihara Putra Swamy Temple complex while exempting Sections 15 & 29 of the Act and as per Section 154 of the Act and re-hand over the temple to the Endowments Department, but so far, no action is taken thereon and the same is pending.

When the matter is taken up, both the learned counsel agreed for disposal of the writ petition with a direction to the 2nd respondent to expeditiously dispose of the representation of the petitioners.

Having regard to the same, without expressing any opinion on the merits of the matter, the Writ Petition is disposed of directing the 2nd respondent to consider the representation of the petitioners, dated 18.11.2016, pass appropriate orders, as warranted by law, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order and communicate the decision to the petitioners. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
