THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY WRIT PETITION No.46227 of 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of respondent No.7 in trying to demolish the existing compound wall, which was constructed way back in the year 1989 in Premises No.1-51/51 situated at Pangra (B) Village, Nizamabad Mandal and District, without disposing of the representation of the petitioner dated 12.10.2016, as illegal and arbitrary. 2.

Heard the learned counsel for the petitioner and the learned Standing Counsel for Local Bodies of State of Telangana representing respondent Nos.6 and 7.

A perusal of the record reveals that the petitioner herein purchased a house bearing No.1-51/51 from one Akthar Hussain under a registered sale deed dated 01.05.2001. The petitioner also constructed a first floor on the said premises after obtaining necessary permission from respondent Nos.6 and 7. While so, on 30.09.2016, respondent Nos.6 and 7 issued a notice directing the petitioner herein to remove the compound wall alleged to have been constructed in the Gram Panchayat place. On 12.10.2016 the petitioner submitted her explanation. For one reason or other, respondent Nos.6 and 7 did not dispose of the said representation of the petitioner.

Having regard to the facts and circumstances of the case, respondent Nos.6 and 7 are hereby directed to dispose of the representation of the petitioner dated 12.10.2016 in the light of the

provisions of the Telangana Panchayat Raj Act and Rules made thereunder as expeditiously as possible.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
