HONOURABLE SRI JUSTICE S.V.BHATT WRIT PETITION No. 12619 of 2015 ORDER:

The petitioner prays for Mandamus declaring the action of third respondent in refusing to receive, register and release the document alleged to have been presented by the petitioner in respect of house property consisting of RCC building

and two tiled houses along with vacant site for an extent of 99.75 square yards vide Door Nos. 35-51, 35-52 and 35-53 situated in Sy.No.162/2, Old Ward No.14, New Ward No. 19, Block No.35, Western row of Barkasu Street Municipal Road, Salur Village and Municipality, Vizianagaram District as illegal, arbitrary and without jurisdiction.

This Court, through order dated 06.03.2014 in Writ Petition No. 1339 of 2014 and batch, has considered legality of objection in refusing to register on the ground that the petitioner land is 'Gramakantam' and held that occupied 'Gramakantam' cannot be claimed as property belonging to Government and on such presumptuous approach include the property in the prohibited list. For the reasons recorded in Writ Petition No. 1339 of 2014 and batch, the Writ Petition is ordered.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
