HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 32928 of 2018 ORDER:

1) Heard learned counsel for the petitioner and Government Pleader for Revenue (AP). With the consent of both the parties, the main writ petition is being taken up for disposal at the admission stage itself.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondent No.2 in not considering the recommendation made by respondent No.4 through the proceedings in Roc.DT/ 74/ 2013, dated 30.05.2016 for assignment of land in favour of the petitioner, on payment of market value in an extent of Ac.2.28 cents in Sy.No.302/ 1 of Gangavaram Village, Gangavaram Mandal, Chittoor District, as arbitrary and illegal.

3) When the matter is taken up for hearing, the learned Government Pleader placed on record the written instructions received by him, wherein it is stated that the Tahsildar had submitted a detailed report to the Sub-Collector, Madanapally to drop the transfer and alienation proposals submitted by the then Tahsildar, Gangavaram, vide Roc.DT/ 74/ 2013, dated 21.04.2018, who inturn submitted a detailed report to the Collector, Chittoor, vide Roc.D1/ 3042/ 2016, dated 02.05.2018.

4) Having regard to the facts and circumstances of the case, the District Collector, Chittoor (respondent No.2), shall take a decision in that regard and pass appropriate orders, as early as possible, preferably, within a period of eight to ten weeks from the date of receipt of a copy of the order, and intimate the decision taken to the petitioner, at the earliest. 5) With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

6) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
