THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4815 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioners/A.1 and A.2 seeking grant of anticipatory bail in connection with crime No.116 of 2015 on the file of the Manuguru Police Station, Khammam District, registered for the offence under Section 384 IPC. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor.

The allegation against the petitioners is that they have taken away the vehicle, which belongs to the de facto complainant and refused to return the same and demanding the dues to be paid to them. It is also alleged that the petitioners threatened the de facto complainant that nobody can do anything to them as they are powerful persons to influence anybody.

On perusing the records, this Court is of the view that grant of anticipatory bail will not cause any prejudice to the de facto complainant. Hence, this Court is inclined to grant anticipatory bail to the petitioners/A.1 and A.2. In the circumstances, the petitioners/A.1 and A.2 are directed to surrender before the Magistrate concerned within a period of fifteen days from today and on such surrender, they shall be enlarged on bail on their executing personal bonds for a sum of Rs.1,00,000/- (Rupees one lakh only) each with two sureties for a like sum each to the satisfaction of the Magistrate concerned. Further, the petitioners/A.1 and A.2 are directed to report before the Station House Officer concerned daily between 10.00 a.m., and 5.00 p.m., until further orders.
