THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 19070 of 2016 ORDER :

Heard the learned counsel for the petitioner and Sri Sampath Prabhakar Reddy, learned Standing Counsel for respondents 2 and 3. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission.

2. The present Writ Petition came to be filed with the following prayer:

"... to pass an order or direction or writ more particularly one in the nature of writ of mandamus declaring the high-handed and illegal action of the Respondents in trying to demolish the Premises Bearing No.1-72/3/15/1 (Part) on Part of Plot No.1, admeasuring 88 Sq. Yds or 75.08 Sq.Mts. situated at Gachibowli Village, Serilingampally Mandal, under GHMC, Ranga Reddy District belongs to Petitioner by interfering with his peaceful possession and enjoyment over it without following the due process of law as it being illegal, arbitrary, unconstitutional and in violation of principles of natural justice and also violation of provisions of GHMC Act and consequently direct the respondents not to demolish the above property by interfering with the peaceful possession and enjoyment of the Petitioner over it and pass..."

3. Though various grounds are raised in the Writ Petition, learned counsel for the petitioner submits that the

respondents authorities are trying to demolish the aforesaid building without following due process of law. On the other hand, learned Standing Counsel for respondents 2 and 3, on instructions, submits that the respondents 2 and 3 will follow due process of law before taking steps for demolition of the building or dispossessing the petitioner.

4. In view of the submissions made and having regard to the circumstances of the case, respondents 2 and 3 are directed to follow due process of law before taking any steps for demolition of the building, or dispossession of the petitioner from the premises, bearing No.1-72/3/15/1 (Part) on Part of Plot No.1, admeasuring 88 Sq. Yds or 75.08 Sq.Mts.

situated at Gachibowli Village, Serilingampally Mandal, Ranga Reddy District.

5. The Writ Petition is disposed of with the aforesaid direction. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
