THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.12957 of 2010 ORDER:

This criminal petition is filed under Section 482 of Cr.PC to quash the proceedings against the petitioners/A1 to A8 in Crime No.209 of 2010 on the file of the Station House Officer, Ongole Taluq Police Station, Prakasam District, registered for the offence under Section 498A IPC.

The learned counsel for both the parties, in one voice, submitted that the petitioner Nos.2 and 3/A2 and A3 are no more. The petitioner Nos.1, 5, 7 and 8/A1, A5, A7 and A8 are present. The petitioner Nos.4 and 6/A4 and A6 are absent. The second respondent-de facto complainant is present.

Sri M.Ravindra, learned counsel identified the petitioner Nos.1, 5, 7 and 8/A1, A5, A7 and A8. Sri Syed Ghouse Basha, learned counsel identified the second respondent. 4.

The second respondent, in the open court, voluntarily submitted that she wants to withdraw the case against the petitioner Nos.1 to 8/A1 to A8 in view of the advice given by the elders of both sides. Both the parties are inter-related to each other. The offence under Section 498-A IPC is only a matrimonial offence. In view of the interference of the elders on both sides, the dispute seems to be amicably settled between the parties. Therefore, no purpose will be served by keeping the matter pending.

5. Taking into consideration the facts and circumstances of the case and in view of the voluntary submission made by the second

respondent in the open court, she is permitted to withdraw crime No.209 of 2010. Hence, I am of the considered opinion that it is a fit case to quash the proceedings.

In the result, the criminal petition is allowed, quashing the proceedings against the petitioners/A1 to A8 in Crime No.209 of 2010 on the file the Station House Officer, Ongole Taluq Police Station, Prakasam District against the petitioners/A1 to A8. Miscellaneous petitions, if any, pending in the criminal petition shall stand closed.
