HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.17402 OF 2016 O R D E R :

This writ petition is filed against the order dated 23.04.2016 passed by the 2nd respondent in Case No.D1/1962/2010 wherein the Revision filed by the petitioner under Section 9 of the Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act') for correction of entries in the Revenue records from 1995-96 onwards in respect of lands bearing Sy.No.625, 627, 628, 629, 630, 631, 632, 633, 635, 636 admeasuring Ac.69-16 guntas situated at Shamshabad Village and Mandal, Ranga Reddy District was dismissed by holding that the questions raised in the Revision cannot be enquired in summary enquiry and that the parties have to approach the competent Civil Court for adjudicating their respective claims.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

A perusal of the order passed by the 2nd respondent goes to show that the petitioner has filed Revision seeking correction of entries in the revenue records from the year 1995-96 onwards and the 2nd respondent has considered the matter elaborately and dismissed the Revision by relying on several judgments of High Court.

No infirmity is brought to my notice in the order passed by the 2nd respondent warranting interference of this Court. Therefore, the writ petition is dismissed granting liberty to the petitioner to approach the competent Civil Court for seeking declaration of his title under chapter VI of the Specific Relief Act, 1963 and in accordance with Section 8 (2) of the Act. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
