HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.3090 of 2016 ORDER:

The petitioner is working as Field Assistant. He was removed from service by proceedings dated 08.09.2015 of the Project Director, DWMA, Nellore (3rd respondent) on the allegations leveled in the show cause notice. Against the said order, petitioner claims to have preferred appeal to the Commissioner Rural Development Department, Andhra Pradesh, (2nd respondent) on 23.11.2015 and the said appeal is not disposed of. Aggrieved by the inaction on the part of the 2nd respondent in not disposing of the appeal, this writ petition is filed.

2. Since the remedy of appeal is exhausted by the petitioner, and the same is pending consideration with the 2nd respondent, without expressing any opinion on merits, the writ petition is disposed of directing the 2nd respondent to consider the appeal filed by the petitioner and pass orders as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
