HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8869 OF 2017 ORDER:
The writ petition is filed questioning the auction notice dated 28.02.2017, issued by the 3rd respondent and the auction schedule on 14.03.2017 in so far as granting of license in Boyakonda Gangamma Devasthanam for collecting coconut half.
The auction is scheduled to be held today at 11.00 a.m. The learned standing counsel for the Endowment Department, on instructions, submits that there are total about seven bidders participated in the bid including the petitioner. The bid went for a sum of Rs.7,64,000/- as against Rs.6,84,000/- that was being paid by the petitioner. Inasmuch as the petitioner has already participated in the auction, nothing survives in the writ petition. In those circumstances, it is not necessary for this Court to consider the legal contentions raised with regard to the rule position and applicability of the rule in the present writ petition. However, it is made clear that so far as the validity, applicability and scope of the rules are concerned, the issue is left open. Accordingly, the writ petition is closed. No order as to costs. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
