Yes/No ORDER:

This Criminal Petition is filed under Sec.482 of Cr.P.C. seeking modification of the orders of the learned Principal Sessions Judge, Karimnagar in Crl.MP.No.307 of 2015, dt. 07.04.2015.

2. By the impugned order, the learned Sessions Judge has granted bail to the Petitioner/A5 and two others on their executing a bond for Rs.25,000/- each by way of cash or FDR, with two cash sureties of Rs.25,000/- each in the shape of FDR, to the satisfaction of the Additional Judicial Magistrate of First Class, Karimnagar, along with other conditions.

3. The present petition is filed by the petitioner/A5 stating that the direction of the learned Sessions Judge to furnish two cash sureties of Rs.25,000/- each in the shape of FDR is erroneous and improper, and the petitioner, being a poor person, is not in a position to furnish the same, and hence sought for modification of the same.

4. Taking into consideration the above circumstances, the condition imposed by the learned Sessions Judge directing the petitioner herein to furnish two cash sureties of Rs.25,000/- each is modified. Instead, the petitioner can furnish any two sureties to a tune of Rs.25,000/- to the satisfaction of Addl. Judicial Magistrate of First Class, Karimnagar, and if there is any suspicion about the

said sureties being genuine, it is always open to the learned Magistrate to take such steps that are necessary for satisfying himself about the genuineness of the sureties.

5. Accordingly, this Criminal Petition is allowed. Consequently, the miscellaneous applications pending, if any, shall stand closed accordingly. __________________ M.S.K.JAISWAL,J Date: 04.08.2015 Kv
