O R D E R

The only grievance of the petitioner, who is the accused in Cr.No.110 of 2017 on the file of Police Station, Kakatiya University, Warangal, which was registered for the offences punishable under Sections 420, 468, 470 and 506 read with 34 IPC., is that the 2nd respondent - Station House Officer, Police Station Kakatiya University, Warangal District, while conducting investigation in the said crime, is not following the procedure laid down under Section 41-A of Cr.P.C.

Heard the learned counsel for the petitioner. Learned Assistant Government Pleader for Home produced written instructions of Sub Inspector of Police, Kakatiya University Police Station, dated 17.09.2018, denying the allegation of the petitioner and stating that investigating officer will follow the due procedure under Section 41-A of Cr.P.C., while conducting investigation in Cr.No.110 of 2017. Recording the above statement made in the written instructions, writ petition is disposed of directing the 2nd respondent to follow the procedure laid down under Section 41-A of Cr.P.C. and the guidelines laid down by Apex Court ARNESH KUMAR vs. STATE OF BIHAR1 and take action in accordance with law.
