HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION M.P. No.1671 OF 2017 IN/AND CRIMINAL PETITION No.1722 OF 2017 COMMON ORDER:

The present Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioners requesting to quash the proceedings against them in C.C. No.462 of 2016 on the file of III Metropolitan Magistrate, Cyberabad at L.B. Nagar, arising out of Crime No.432 of 2016 of Uppal Police Station, Cyberabad.

2. The petitioners - accused Nos.1 to 3 viz., Vanchala Laxma Reddy, Gaddamidi Shiva and Devarakonda Krishnaiah, respectively, alleged to have committed the offences punishable under Sections 353 and 427 of the Indian Penal Code, 1860.

3. Criminal Petition M.P. No.1671 of 2017 is filed by the de facto complainant viz., Chinnam Rajendra Prasad, under Sections 323 of the Code of Criminal Procedure, 1973, requesting to record the compromise and to quash the aforesaid proceedings against the petitioners.

4. The de facto complainant, a Line Inspector of TSSPDCL, is no other than a public servant, and, having lodged a complaint expressing grievance against the petitioners, is not supposed to come

ASN,J Crl.P. No.1722 of 2017 forward to effect compromise as the offences were said to have committed by the petitioners while he was discharging his official duties.

5. Therefore, Criminal Petition M.P. No.1671 of 2017 as well as the Criminal Petition are dismissed, at the admission stage itself. As a sequel thereto, Miscellaneous Petitions, if any, pending in the Criminal Petition stand closed.
